terms & conditions.
These Terms and Conditions (“Terms”) govern your access to and use of the Tufty website and your purchase of products, artwork, commissions, workshops, event registrations, or other services offered through it. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website.
about tufty.
“Tufty,” “we,” “us,” and “our” refer to Alyssa Book, operating under the artist name Tufty, in Parkland, Florida. Questions may be sent to alyssa@tuftyrugs.com.
eligibility and acceptable use.
You must be able to enter a legally binding agreement to make a purchase. If you are under the age of majority where you live, a parent or legal guardian must make the purchase or registration for you.
You may not misuse the website; interfere with its security or operation; introduce malicious code; attempt unauthorized access; scrape or harvest information through automated means without permission; impersonate another person; commit fraud; or use the website or its content for an unlawful purpose.
product information and artist variation.
We make reasonable efforts to describe and display products accurately. Screen settings, lighting, materials, and photography may cause colors or textures to appear differently in person. Handmade, hand-finished, vintage, recycled, or fiber-based work may include natural variations in color, dimensions, texture, pattern placement, fibers, or finish. These variations are part of the artwork and are not necessarily defects.
Dimensions are approximate unless expressly guaranteed in writing. Product images may include display props that are not included. Please read the full listing before purchasing.
orders, availability, and refusal.
Your submission of an order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including product unavailability, listing or pricing errors, suspected fraud, payment issues, shipping restrictions, or inability to complete a custom request. If we cancel after payment, we will refund the amount charged for the canceled portion.
Items placed in a cart are not reserved until checkout is completed. Limited or one-of-a-kind work may sell out.
prices, payments, and taxes.
Prices are listed in U.S. dollars unless stated otherwise and may change without notice. Applicable shipping charges and taxes are calculated or displayed during checkout. You authorize the applicable payment provider to charge the payment method submitted for the full order amount.
Obvious typographical, pricing, or availability errors may be corrected. We may cancel an affected order and issue a refund rather than fulfill it at an erroneous price.
commissions and custom work.
Custom and commissioned work may require a separate proposal, contract, invoice, deposit, approval schedule, and production timeline. Work does not begin until any required agreement is accepted and payment or deposit is received.
Unless the written commission agreement says otherwise:

deposits become nonrefundable once design or production work begins;

changes outside the agreed scope may require additional fees and time;

timelines are estimates and depend on timely customer feedback and approvals;

the customer represents that they have permission to provide and authorize use of any reference image, logo, text, or other material they submit; and
-
ownership and permitted use of the finished physical artwork do not include the underlying copyright.
Transaction-specific commission terms control if they conflict with these general Terms.
workshops, classes, and events.
Workshop, class, or event listings may include separate requirements, age limits, safety rules, cancellation deadlines, and refund terms. Participants must follow reasonable venue and instructor instructions. A participant may be removed without refund for conduct that is unsafe, unlawful, severely disruptive, or harmful to others.
If Tufty cancels a paid session, registrants will receive a refund or an offered transfer or rescheduling option. Tufty is not responsible for incidental costs such as travel, lodging, childcare, or supplies purchased elsewhere unless required by law.
shipping, returns, and refunds.
The Shipping Policy and Refund and Return Policy are incorporated into these Terms. Please review them before purchasing.
intellectual property.
The website and its contents—including artwork, designs, photographs, videos, graphics, logos, text, product names, course materials, and downloadable materials—are owned by or licensed to Tufty and are protected by copyright, trademark, and other intellectual-property laws.
Purchasing an original artwork, print, commission, or other product transfers ownership only of the physical item, unless a written agreement expressly says otherwise. It does not transfer copyright or grant permission to reproduce, digitize, mint as an NFT, modify, distribute, sell copies of, use for machine-learning or artificial-intelligence training, or commercially exploit the artwork.
You may share photographs of purchased artwork for personal, noncommercial purposes if the artwork is not altered or presented misleadingly and credit is given to Tufty where reasonably possible. Commercial use, publication, licensing, or reproduction requires prior written permission.
customer materials and reviews.
You retain ownership of materials you submit. By sending materials needed for an order or commission, you grant Tufty a limited permission to use them to evaluate, create, fulfill, document, and support that transaction.
If you voluntarily submit a review, testimonial, tagged social-media post, or customer photo and give us permission to feature it, you grant Tufty a nonexclusive, worldwide, royalty-free license to reproduce and display that submitted content for promotional purposes. You represent that you own or control the necessary rights. Permission may be withdrawn for future uses by contacting us, although materials already printed or published may not be retractable.
third-party services and links.
The website may rely on or link to third-party platforms, payment processors, fulfillment partners, carriers, social networks, and other services. Their separate terms and policies may apply. We do not control and are not responsible for third-party websites or services, except to the extent responsibility cannot legally be excluded.
disclaimer of warranties.
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” We do not promise that the website will always be uninterrupted, error-free, secure, or free of harmful components. Products are subject to any express description or warranty provided in the applicable listing and to rights that cannot be excluded under law.
limitation of liability.
To the fullest extent permitted by law, Tufty will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a purchase. To the fullest extent permitted by law, Tufty’s total liability for a claim relating to a purchase will not exceed the amount paid for the product or service giving rise to that claim.
These limitations do not apply where liability cannot legally be limited or excluded.
indemnification.
To the extent permitted by law, you agree to indemnify and hold Tufty harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or materials you submit without the necessary rights. This section does not apply to the extent a claim was caused by Tufty’s own wrongful conduct.
governing law and venue.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal proceeding that is not eligible for small-claims court will be brought in a court of competent jurisdiction located in Broward County, Florida, unless applicable consumer law requires otherwise.
Before filing a formal claim, you and Tufty agree to make a good-faith effort to resolve the issue by written notice and informal discussion for at least 30 days, unless immediate relief is reasonably necessary or the law requires a different process.
changes to these terms.
We may update these Terms from time to time. The version posted when you place an order generally governs that transaction, unless a change is required by law or you agree otherwise. Continued use of the website after revised Terms are posted means you accept the revised Terms for future use.
severability and no waiver.
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure to enforce a provision once is not a waiver of the right to enforce it later.
These Terms, the Privacy Policy, Shipping Policy, Refund and Return Policy, and any applicable product listing, proposal, commission agreement, workshop terms, or invoice form the agreement between you and Tufty concerning the relevant transaction. Transaction-specific written terms control where they expressly conflict with these general Terms.
